FlowFitness End-User Terms of Service
These End-User Terms of Service ("Terms") constitute a binding and enforceable agreement between NovaRidge Commerce LLC, doing business as FlowFitness ("FlowFitness") and you ("User," "you") each time you use the FlowFitness Services. User and FlowFitness shall collectively be referred to as the "parties" and each as a "party."
By accepting these Terms electronically or by using the Services, you agree to comply with these Terms. If you do not agree, you may not use the Services.
ARBITRATION NOTICE FOR USERS IN THE UNITED STATES
THESE TERMS CONTAIN AN ARBITRATION CLAUSE AND A WAIVER OF RIGHTS TO BRING A CLASS ACTION AGAINST US. EXCEPT FOR CERTAIN TYPES OF DISPUTES MENTIONED IN THE ARBITRATION CLAUSE, YOU AND FLOWFITNESS AGREE THAT DISPUTES WILL BE RESOLVED BY MANDATORY BINDING ARBITRATION, AND BOTH PARTIES WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS-ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. 2.1.
FlowFitness provides subscription-based digital services through its platform ("Services"). By subscribing, you gain access to features available during your active subscription period.
2.2.
FlowFitness processes subscription payments and provides access to the Services. Subscriptions automatically renew at the end of each billing cycle unless canceled before renewal.
2.3.
FlowFitness reserves the right to modify, add, or remove features at any time without prior notice.
2.4.
Certain elements of the Services may rely on third-party providers. FlowFitness is not responsible for third-party content, performance, or functionality.
2.5.
Subscription charges may appear on your billing statement as "FlowFitness" or our payment processor’s name.
3. Account Registration and Requirements
3.1.
You must create an account and provide accurate and complete information. You are responsible for maintaining the confidentiality of your credentials.
3.2.
By using the Services, you represent that:
You are at least 18 years old (or the age of majority in your jurisdiction)
You have legal capacity to enter into this agreement
Information you provide is accurate
You will not use the Services for unlawful or abusive purposes

You must notify FlowFitness immediately of any unauthorized account use.
4. Restrictions of Use
You agree to comply with all applicable laws. You may not:
(i) Access the Services through unauthorized means
(ii) Circumvent security measures
(iii) Share account credentials
(iv) Reverse engineer or disassemble the Services
(v) Transmit unlawful or infringing content
(vi) Disrupt or impair the Services
(vii) Use bots or automated systems without authorization
(viii) Copy or distribute content without permission
(ix) Use the Services to build a competing product
5. Subscription and Payments
5.1.
By subscribing to FlowFitness, you authorize recurring charges to your payment method.
5.2.
You are responsible for maintaining valid payment information.
5.3.
Fees are charged in advance and may exclude applicable taxes.
5.4.
FlowFitness may change pricing with 30 days’ notice.
5.5.
You may cancel at any time; cancellation takes effect at the end of the billing period.
5.6.
Refunds are handled in accordance with our Refund Policy.
5.7.
FlowFitness is not responsible for additional charges imposed by your payment provider.
6. Refund Policy
6.1.
Refunds are provided in accordance with applicable law and our Refund Policy.
6.2.
Refunds may be available:
For unused subscription portions canceled within 7 days
For technical issues preventing access not resolved within 48 hours
If FlowFitness fails to deliver the Services as described

FlowFitness reserves the right to refuse refunds in cases of fraud, abuse, or chargebacks.

Initiating a chargeback may result in account suspension.
7. Your Data
7.1.
FlowFitness may collect and process Personal Data including name, email address, IP address, subscription information, usage data, contact information, and billing information, as described in the FlowFitness Privacy Policy.

Your Data remains your property. You grant FlowFitness a limited license to process your Data to provide the Services.
7.3.
FlowFitness processes Personal Data in accordance with applicable data protection laws, including GDPR and CCPA where applicable.
8. Intellectual Property Rights
8.1.
FlowFitness owns all rights, title, and interest in the Services and platform technology.
8.2.
You are granted a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes during your active subscription.
8.3.
You may not reproduce, modify, or distribute Service content without authorization.
9. Warranties; Disclaimers; Limitation of Liability
9.1.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
9.2.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLOWFITNESS SHALL NOT BE LIABLE FOR LOST PROFITS, LOSS OF DATA, OR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
9.3.
FLOWFITNESS’S MAXIMUM LIABILITY SHALL NOT EXCEED THE TOTAL SUBSCRIPTION FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.
10. Termination
10.1.
You may terminate by canceling your subscription.
10.2.
FlowFitness may suspend or terminate your access if:
You breach these Terms
You engage in unlawful activity
Payment fails
Required by law
10.3.
Certain provisions survive termination, including payment obligations and limitations of liability.
11. Dispute Resolution and Arbitration
11.1.
U.S. users agree that disputes shall be resolved by binding arbitration in Wilmington, Delaware.
11.2.
Arbitration shall be administered by Judicial Arbitration and Mediation Services (JAMS).
11.3.
You may opt out of arbitration within 30 days of first accepting these Terms by sending written notice to:

12. General Provisions
12.1.
These Terms constitute the entire agreement between you and FlowFitness.
12.2.
FlowFitness may update these Terms; material changes will be communicated.
12.3.
If any provision is invalid, the remainder remains enforceable.

These Terms are governed by the laws of the State of Delaware.
12.5.
You may not assign these Terms. FlowFitness may assign them without restriction.

Nothing herein creates a partnership, joint venture, or agency relationship.
